Welcome to The Spilit App. These Terms and Conditions govern your access and use of the The Spilit real estate mobile application and services. By accessing or using the App, you agree to comply with these Terms. If you do not agree, please do not use the App.
- Definitions
- “Company” / “We” / “Us” refers to The Spilit, the owner and operator of the App.
- “User” / “You” refers to any individual using the App, whether as a property seeker or a real estate agent.
- “Agent” refers to real estate professionals who list properties for sale or rent.
- “Service” refers to the functionalities offered by the App, including property browsing, messaging, and listing management.
- “Content” refers to text, images, videos, and other materials uploaded or shared within the App.
- Eligibility
To use the App, you must:
- Be at least 18 years old (or the legal age in your country).
- Have the legal authority to enter into this agreement.
- Provide accurate and complete registration details.
We reserve the right to suspend or terminate accounts that violate these eligibility requirements.
- Account Registration & Security
3.1 Creating an Account
- Users must register with a valid email, phone number, and password.
- Agents must provide license details and identity verification.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to notify us immediately of any unauthorized access or security breach.
We are not responsible for any loss resulting from unauthorized use of your account.
- User Roles & Responsibilities
4.1 Property Seekers
- Can browse and search property listings.
- Can contact real estate agents via in-app chat.
- Must not use the app for fraudulent inquiries.
4.2 Real Estate Agents
- Must only post genuine property listings.
- Must comply with real estate laws in their jurisdiction.
- Are solely responsible for the accuracy and legality of property information.
Agents who violate these terms may be permanently banned from the App.
- Listings & Content Policy
5.1 Acceptable Content
By posting a property listing, you agree that:
- All details (price, photos, description) are accurate and truthful.
- Listings do not infringe any copyrights or third-party rights.
- You have the legal right to sell or rent the listed property.
5.2 Prohibited Content
You must not post content that:
- Contains false or misleading information.
- Violates any local, state, or federal laws.
- Includes offensive, discriminatory, or defamatory material.
- Promotes spam, fraud, or illegal activities.
We reserve the right to remove any content that violates these policies.
- Payment Terms
6.1 Subscription & Fees (For Agents)
- Agents may be required to purchase a paid subscription to post listings.
- Subscription fees are non-refundable unless otherwise stated.
6.2 Payment Processing
- Payments are processed via third-party payment providers.
- We do not store or process credit card details.
- In-App Communication
- Users and agents can communicate via secure in-app messaging.
- Harassment, spam, or abusive behavior will result in account suspension.
- We do not monitor private messages unless flagged for policy violations.
- Intellectual Property
- App Ownership: All content, trademarks, logos, and software in the App belong to The Spilit.
- Limited License: Users are granted a non-exclusive, non-transferable license to use the App for personal or business use only.
- Restrictions: You may not modify, distribute, or reverse-engineer the App.
- Privacy & Data Protection
- Your personal information is handled according to our [Privacy Policy].
- We implement industry-standard security but cannot guarantee 100% protection.
- By using the App, you agree to our data collection and usage practices.
- RESTRICTIONS & PROHIBITED USES
You may not:
- Use the App for illegal purposes.

- Scrape or extract data from the App using automated tools.
Violating these restrictions may lead to permanent account termination and legal action.
- Termination & Account Suspension
We reserve the right to suspend or terminate your account if:
- You violate these Terms & Conditions.
- We detect fraudulent, misleading, or illegal activity.
- We receive multiple complaints against your account.
You may delete your account at any time via Account Settings.
- Limitation of Liability
We are not responsible for:
- Inaccurate property listings posted by agents.
- Financial losses resulting from transactions between users.
- Service interruptions due to maintenance or technical issues.
- Third-party actions, including hacking, cyber-attacks, or fraud.
Maximum Liability: If found liable, our maximum responsibility shall not exceed the total amount paid by the user in the last 6 months.
- Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the App.
- Your violation of these Terms.
- Any disputes or transactions between you and another user.
- Third-Party Links & Services
- The App may contain links to third-party websites or services.
- We do not control or endorse external sites.
- Using third-party services is at your own risk.
- Governing Law & Dispute Resolution
